Introduction

snap takes the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the General Data Protection Regulations and this Privacy Statement. Registered data (personal details, including name, company, telephone number, e-mail address) will only be used for communication and transmission of information with you. The data are stored as long as they are needed for the processing of your inquiry or for the fulfilment of the contract or as long as we need them out of justified interest for our purposes.

We have created this Privacy Statement to demonstrate our firm commitment to the individual`s right to data protection and privacy. This Privacy Statement outlines how we handle information that can be used to directly or indirectly identify an individual.

When does this Privacy Statement apply?

This Privacy Statement applies to Personal Data that you provide to snap within your subscription of snap Cloud Services, Software and other Services. What information do we collect? For the purpose of the subscription of snap Cloud Services, Software and other Services we collect user-specific information of our customers, such as: name, email address, phone number, address, user and/or employee id, system access / usage. In the context of our customers scanning business card data of their prospects and end-customers, we do not store any personal data coming from the business cards scanned. We process the data read and send them directly into our onPremise CRM System where the data is stored.

How do we use personal information?

All personal data are processed and used in accordance with the relevant data protection regulations, in particular the Austrian Federal Data Protection Act (GDPR).

What legal basis do we have for processing your Personal Data?

Legal basis for the processing of the personal data is the general data protection regulation in Austria (GDPR). In the following cases, snap is permitted to process your Personal Data under the applicable data protection law:

Ensuring compliance.

snap and its products, technologies, and services are subject to the export laws of various countries including, without limitation, those of the European Union and its member states. You acknowledge that, pursuant to the applicable export laws, trade sanctions, and embargoes issued by these countries, snap is required to take measures to prevent entities, organizations, and parties listed on government-issued sanctioned-party lists from accessing certain products, technologies, and services through delivery channels controlled by snap. This may include (i) automated checks of any user registration data as set out herein and other information a user provides about his or her identity against applicable sanctioned-party lists; (ii) regular repetition of such checks whenever a sanctioned-party list is updated or when a user updates his or her information; (iii) blocking of access to snap’s services and systems in case of a potential match; and (iv) contacting a user to confirm his or her identity in case of a potential match.

Providing the requested goods or services.

If you order goods or services from snap, snap will use the Personal Data that you enter into the order or registration form (usually (a subset of) your name, (email) address, telephone number, company name and address, your job title and role and, if payment is to be made to snap, credit card number or bank details) only to process your order or to provide the requested goods or service. This may include taking the necessary steps prior to entering into the contract, responding to your related inquiries, and providing you with shipping and billing information and to process or provide customer feedback and support. This may also include conversation data that you may trigger via the chat functionalities or other local snap web presences, contact forms, emails, or telephone. In this Privacy Statement, “goods and services” includes (access to) snap’s web services, offerings, contests, other content, non-marketing related newsletters, whitepapers, tutorials, trainings and events.

snap’s legitimate interest

Each of the use cases below constitutes a legitimate interest of snap to process or use your Personal Data. If you do not agree with this approach, you may object against snap’s processing or use of your Personal Data as set out below.

  • Creation of anonymized data sets. snap may anonymize Personal Data provided under this Privacy Statement to create anonymized data sets, which will then be used to improve its and its affiliates’ products and services.
  • Questionnaires and surveys. snap may invite you to participate in questionnaires and surveys. These questionnaires and surveys will be generally designed in a way that they can be answered without any Personal Data. If you nonetheless enter Personal Data in a questionnaire or survey, snap may use such Personal Data to improve its products and services.
  • In order to keep you up-to-date/request feedback. Within an existing business relationship between you and snap, snap may inform you, where permitted in accordance with local laws, about its products or services (including webinars, seminars or events) which are similar or relate to such products and services you have already purchased or used from snap. Furthermore, where you have attended a webinar, seminar or event of snap or purchased products or services from snap, snap may contact you for feedback regarding the improvement of the relevant webinar, seminar, event, product or service.

Transfer of personal data to third parties:

Your personal data will only be known to those persons who are dealing with the processing of your inquiry, the processing of your order and the transmission of newsletters. However, a transfer of personal data to third parties can take place if you have expressly agreed to the transfer or if the transfer is permitted by data protection law. In some cases, our data processing is carried out by a data processor, who is bound by our instructions and obliged according to data protection regulations and who is not allowed to use the data for any other purpose.

How long do we keep your Personal Data for?

Where snap is processing and using your Personal Data as permitted by law or under your consent, snap will store your Personal Data (i) only for as long as is required to fulfil the purposes set out below or (ii) until you object to snap’s use of your Personal Data (where snap has a legitimate interest in using your Personal Data), or (iii) until you withdraw your consent (where you consented to snap using your Personal Data). However, where snap is required by mandatory law to retain your Personal Data longer or where your Personal Data is required for snap to assert or defend against legal claims, snap will retain your Personal Data until the end of the relevant retention period or until the claims in question have been settled.

Regarding your rights in relation to Personal Data

You are entitled to request information about the personal data stored by us, to have incorrect data corrected, or to request the deletion or freezing of your data as well as the portability of your personal data. You may object to the use of your data at any time with effect for the future. There are, however, cases where we are not allowed to delete your data in its entirety as a result of legal retention periods.
